This denial allows Percepto to operate unmanned aerial systems (UAS) beyond visual line of sight (BVLOS) without a human on-site, and was previously required to allow remote preflight checks under Part 107. The required exemption process has been removed.
In the past, the FAA has required Part 107 exemption approval and 14 CFR Sections 107.15 (Conditions for Safe Operation) and 107.49 (Preflight Familiarization, Inspections, and Conduct for Aircraft Operations) to conduct UAS BVLOS operations. exemption from both. people on site. This process typically takes years for approval and is disproportionate to the risks involved. In particular, the text of Part 107 does not specify that a pre-flight inspection must be performed directly.
Percepto has certified to the FAA that its pre-flight inspection exceeds Part 107 requirements and therefore does not require an exemption. The company’s inspection process features UAS inspections using cameras and images surrounding the base to verify safe deployment. Percepto has reached out to the FAA to address questions about exceeding the FAA’s expectations for the pre-flight inspection process. This milestone will help move the entire industry forward as Percepto aims to streamline the application and approval process for BVLOS UAS operations.
“Percepto is very appreciative of the FAA staff involvement and consideration of our CONOPS and technical information to reach this milestone for Percepto and the broader UAS industry.” We are excited about the waiver denial in this difficult situation and look forward to continuing to work with the FAA to bring the significant benefits of scalable BVLOS UAS operations to the U.S. critical infrastructure industry.”
Lisa Ellman, Chair of Hogan Lovells’ Global UAS Practice and External Counsel for Percepto, said: “The FAA is opening the door to industry for a more streamlined and timely approval of BVLOS UAS operations and realizing its benefits for many socially beneficial use cases.”
